Terms & Conditions

General Terms

By downloading, installing, or using Vibework, you confirm that you are in agreement with and bound by the terms of service contained in these Terms & Conditions. These terms apply to the Vibework desktop application and any communication between you and Context AI Technologies Pte. Ltd.

Under no circumstances shall Context AI Technologies Pte. Ltd. be liable for any direct, indirect, special, incidental, or consequential damages, including but not limited to loss of data, loss of files, system damage, or business interruption arising out of the use of Vibework, even if we have been advised of the possibility of such damages.

IMPORTANT: Vibework is a desktop AI agents platform that uses multiple automation approaches — including AppleScript, COM automation, MCP servers, and agent frameworks — to perform tasks on your computer with your permission. It can access files, execute commands, and interact with applications on your behalf. You are responsible for reviewing and authorizing all actions Vibework takes. We are not responsible for any data loss, system changes, or unintended consequences resulting from commands or automation actions you authorize Vibework to execute.

Definitions and Key Terms

To help explain things as clearly as possible, these terms are strictly defined as:

• Application / Vibework: The Vibework desktop AI agents platform and all associated software, features, and services.
• Company / We / Us / Our: Context AI Technologies Pte. Ltd., UEN 202537678Z, located at 59 Ubi Avenue 1, #03-11, Singapore 408938.
• You / User: The individual person using Vibework. You must be at least 13 years old to use Vibework.
• Account: Your registered user account required to use Vibework.
• Subscription: Your paid or free plan that determines your access to Vibework's features.
• AI Agent: The artificial intelligence-powered assistant that processes your commands and interacts with your files and system through multiple automation approaches.
• Third-Party AI Services: External AI providers (including Anthropic, Exa, and Composio) that Vibework uses to power its functionality.
• Content: Any data, files, text, prompts, commands, or other materials you input into or generate with Vibework.

License

Subject to your compliance with these Terms & Conditions, Context AI Technologies Pte. Ltd. grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use Vibework on your personal computer(s) for your individual use only.

This license is personal to you and may not be shared, transferred, or assigned to any other person or entity without our written consent. Commercial use of Vibework requires a separate commercial license.

Restrictions

You agree not to, and you will not permit others to:

• Sell, rent, lease, sublicense, distribute, or commercially exploit Vibework or make it available to any third party;
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of Vibework;
• Remove, alter, or obscure any proprietary notices, trademarks, or branding from Vibework;
• Use Vibework to violate any applicable laws or regulations;
• Use Vibework to create, transmit, or store malicious code, viruses, or harmful content;
• Attempt to gain unauthorized access to Vibework's systems, other users' accounts, or third-party services;
• Use Vibework in any way that could damage, disable, overburden, or impair our servers or networks;
• Use automated means (bots, scripts) to access Vibework except as necessary for its intended AI agent functionality;
• Share your account credentials with others or create accounts using false information;
• Use Vibework to infringe upon the intellectual property rights, privacy rights, or other rights of third parties.

Acceptable Use Policy

You are responsible for all activities conducted through your Vibework account. You agree to use Vibework responsibly and in compliance with all applicable laws. You may not use Vibework to:

• Engage in illegal activities or promote violence, terrorism, or harm to others;
• Harass, abuse, threaten, or intimidate others;
• Generate or distribute spam, misinformation, or deceptive content;
• Violate privacy rights or collect personal information about others without consent;
• Attempt to manipulate, deceive, or defraud others;
• Circumvent security measures or attempt to exploit vulnerabilities in Vibework.

We reserve the right to suspend or terminate your account if you violate this Acceptable Use Policy.

Subscription and Payment

Free and Paid Plans

Vibework offers both free and paid subscription plans. Features, usage limits, and capabilities vary by plan. We reserve the right to modify subscription plans, pricing, and features at any time with reasonable notice.

Payment Terms

For paid subscriptions, you agree to pay all fees associated with your chosen plan. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). All fees are non-refundable except as required by law or as expressly stated in these terms.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through Vibework's settings or by contacting us at shrivardhan@hoursense.com.

Price Changes

We may change subscription prices at any time. If we increase prices for your current subscription, we will provide at least 30 days' notice before the change takes effect. Your continued use of Vibework after the price change indicates your acceptance of the new price.

Refunds

If you are not satisfied with Vibework, please contact us at shrivardhan@hoursense.com within 7 days of your initial purchase for a refund consideration. Refunds after this period are at our sole discretion. Refunds do not apply to renewals or usage-based charges.

File Access and Command Execution

IMPORTANT: Vibework can access files and execute commands on your computer only with your explicit permission. By granting these permissions, you acknowledge and accept the following:

Your Responsibility

You are solely responsible for:

• Reviewing and understanding commands before authorizing Vibework to execute them;
• Ensuring you have appropriate backups of important files before allowing Vibework to access or modify them;
• Verifying that file operations and commands are appropriate for your use case;
• Any consequences resulting from commands you authorize Vibework to execute.

Our Limitations

We are NOT responsible for:

• Data loss resulting from commands you authorize;
• System changes or configurations modified by authorized commands;
• Unintended consequences of AI-generated commands, even if you authorized them;
• Errors, bugs, or unexpected behavior in file operations;
• Security vulnerabilities resulting from permissions you grant to Vibework.

USE VIBEWORK AT YOUR OWN RISK. WE STRONGLY RECOMMEND MAINTAINING REGULAR BACKUPS OF ALL IMPORTANT DATA.

Third-Party AI Services

Vibework uses third-party AI services (including Anthropic, Exa, and Composio) to provide its functionality. By using Vibework, you agree that:

• Your prompts, files, and interactions may be processed by these third-party AI providers;
• These providers have their own terms of service and privacy policies that govern their use of your data;
• We are not responsible for the actions, errors, or privacy practices of third-party AI providers;
• AI responses may contain errors, inaccuracies, or inappropriate content, and you should verify important information;
• The availability and quality of AI services depend on third-party providers and may be interrupted or degraded.

Your Content and Data

Ownership

You retain all ownership rights to your files, data, prompts, and content. Vibework does not claim ownership of your content. However, by using Vibework, you grant us a limited license to process, store, and transmit your content as necessary to provide the service.

Your Responsibility

You are responsible for:

• Ensuring you have the right to share any files or content with Vibework;
• Not sharing confidential, proprietary, or legally protected information unless you have authorization;
• Not uploading content that violates copyright, trademark, or other intellectual property rights;
• Maintaining your own backups of important data.

Feedback and Suggestions

Any feedback, suggestions, ideas, or improvements you provide about Vibework become our property. We may use them for any purpose without compensation or attribution to you. This helps us improve Vibework for all users.

Term and Termination

Termination by You

You may terminate your Vibework account at any time by uninstalling the application and deleting your account through Vibework's settings or by contacting us at shrivardhan@hoursense.com. Upon termination, your access to Vibework will cease immediately.

Termination by Us

We may suspend or terminate your account at any time if:

• You violate these Terms & Conditions or our Acceptable Use Policy;
• Your account shows suspicious or fraudulent activity;
• You fail to pay subscription fees when due;
• We discontinue Vibework (with reasonable notice);
• Required by law or government authority.

Effect of Termination

Upon termination: (a) your license to use Vibework terminates immediately; (b) you must uninstall Vibework from all devices; (c) we may delete your account data in accordance with our Privacy Policy; (d) you remain liable for any outstanding fees; and (e) provisions regarding liability, indemnification, and dispute resolution survive termination.

Intellectual Property

Vibework and its entire contents, features, and functionality (including software, algorithms, AI models, interfaces, designs, logos, and documentation) are owned by Context AI Technologies Pte. Ltd. and are protected by Singapore and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from Vibework except as expressly permitted in these Terms & Conditions. Unauthorized use of our intellectual property is prohibited and may result in legal action.

Warranties and Disclaimers

VIBEWORK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT VIBEWORK WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM BUGS;
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF AI-GENERATED CONTENT;
• WARRANTIES THAT VIBEWORK WILL MEET YOUR SPECIFIC REQUIREMENTS;
• WARRANTIES THAT YOUR DATA WILL NOT BE LOST, CORRUPTED, OR COMPROMISED.

AI systems can make mistakes, generate incorrect information, or produce unexpected results. You should verify important information and not rely solely on AI-generated content for critical decisions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CONTEXT AI TECHNOLOGIES PTE. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF DATA, FILES, OR INFORMATION;
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES;
• SYSTEM DAMAGE OR EQUIPMENT FAILURE;
• BUSINESS INTERRUPTION OR DOWNTIME;
• ERRORS IN AI-GENERATED CONTENT OR COMMANDS;
• SECURITY BREACHES OR UNAUTHORIZED ACCESS RESULTING FROM YOUR USE OF VIBEWORK.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO VIBEWORK SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100 USD.

THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Indemnification

You agree to indemnify, defend, and hold harmless Context AI Technologies Pte. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of Vibework; (b) your violation of these Terms & Conditions; (c) your violation of any laws or regulations; (d) content you provide to Vibework; (e) commands you authorize Vibework to execute; or (f) your violation of third-party rights.

Dispute Resolution

Governing Law

These Terms & Conditions are governed by the laws of Singapore, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of Singapore.

Informal Resolution

Before filing any formal dispute, you agree to contact us at shrivardhan@hoursense.com to attempt to resolve the issue informally. We will attempt to resolve any dispute through good faith negotiation within 60 days.

Arbitration (for Non-Singapore Users)

If you are located outside Singapore and informal resolution fails, disputes will be resolved through binding arbitration in accordance with the Singapore International Arbitration Centre (SIAC) rules. You waive any right to a jury trial or to participate in a class action lawsuit.

Changes to These Terms

We may update these Terms & Conditions from time to time. If we make material changes, we will notify you by:

• Posting a notice in Vibework;
• Sending you an email notification;
• Updating the "Last Updated" date at the top of these terms.

Your continued use of Vibework after changes become effective constitutes your acceptance of the new terms. If you don't agree to the changes, you must stop using Vibework and delete your account.

Miscellaneous

Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Context AI Technologies Pte. Ltd. regarding Vibework and supersede all prior agreements.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative.

Assignment

You may not assign or transfer these terms or your Vibework account without our written consent. We may assign these terms at any time without notice to you.

Force Majeure

We will not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, pandemics, network infrastructure failures, or strikes.

Export Compliance

You agree to comply with all applicable export and import laws and regulations. You will not use Vibework in any country subject to embargo or restrictions, and you are not a person or entity prohibited from receiving Vibework.

Third-Party Links

Vibework may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Your use of third-party sites is at your own risk and subject to their terms and privacy policies.
